Disclaimer
The Athletes Housing Network ("AHN")website (the "site") is owned and operated by Athletes Housing Network, Inc., an Oregon Corporation. All visitors and users of the site are legally bound by and agree to the following terms and disclaimer, whether or not such visitor or user takes advantage of the services offered by AHN.
1. The purpose of AHN and the site is to allow amateur athletes ("athlete") to make contact with host families ("host") willing to provide lodging for the athlete during his or her competition in a sporting event.
1.a. In order to search and make contacts with other users of the site, you must register as either a host family or an athlete. Registration information includes full name, city and state, and e-mail address.
1.b. Privacy policy: AHN's services are designed to facilitate contacts between users, therefore, by becoming a registered user of the site and submitting your personal information, you waive any privacy expectations you may have with respect to such information. If you do not wish to have this information seen by or disclosed to others, do not use AHN's services.
2. AHN does not verify any user's identity, nor does AHN accept any responsibility for the accuracy of information provided by any user. AHN does not investigate any registered user as to their reputation, conduct, criminal history or their suitability either as a host or athlete. All users of the site are responsible for determining what information they will request from any other user in order to sufficiently verify that athlete's or host's information.
3. The services provided by AHN are in the nature of a forum only, where communication between athletes and hosts are facilitated. However, AHN takes no part in the communication between the parties, and therefore disclaims any responsibility for the truth of any such communications.
4. The users of the site are responsible for negotiating the terms of the agreement between the athlete and host, such as length of stay, accommodations provided, whether the host is willing and able to provide food and/or transportation, and any other items of concern.
5. AHN is not responsible for any conduct of the athlete or the host, whether criminal or
otherwise; however, AHN urges all registered users to remember the following:
5.a. Athletes, you are a guest in the host's home, and as such you are expected to:
5.a.i. Obey all laws in the host's jurisdiction
5.a.ii. Treat your host with respect and courtesy
5.a.iii. Refrain from damaging any of the host's property
5.b. Hosts, you are an ambassador from your community and its amateur athletes, and as such you are expected to:
5.b.i. Obey all laws in your jurisdiction
5.b.ii. Treat your athlete with respect and courtesy
5.b.iii. Refrain from interfering with the athlete's schedule or training regimen
6. Since, as described above, AHN is providing a forum only, in the event that you, as a user, have a dispute with any other user(s), you agree to release AHN, and any associated individuals or entities, from claims, demands and damages or every kind and nature, whether known or unknown, arising out of or in any way connected to such dispute. If you are a California resident, you waive California Civil Code Section 1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."
7. AHN shall not be liable for damages of any kind in any event, arising from or related to the use or inability to use the site; damages from failure to provide such services as agreed by the host and athlete; statements, conduct or omissions by either host or athlete; any user's conduct or acts, whether criminal or not, in connection with an introduction facilitated by AHN, whether such conduct or acts result in, for example, disqualification from competition, bodily injury, emotional distress, death or any other damages.
8. You agree to defend, indemnify and hold harmless AHN and any associated individuals or entities from, for example, any claims, damages or losses arising from your use of the site. If you are obligated to indemnify, AHN shall have the sole right and discretion to control any action or proceeding and determine whether such action should be settled and on what terms.
9. In the event either a host or athlete engages in inappropriate behavior, including violent or sexual misbehavior, theft, or other disturbing conduct, the victim should immediately report such conduct to local law enforcement. Such behavior may also be reported to AHN at (e-mail address), however such report does not obligate AHN to take any action or cause AHN to incur any liability.
10. The use of AHN's site and services is done at your own risk. Any services provided are on an "as is" and "as available" basis. AHN expressly disclaims, and users waive, all warranties of any kind, whether express or implied. AHN does not warranty that the site or services will: 1) meet your requirements, 2) be uninterrupted, timely, secure or error-free, 3) accurate or reliable, 4) will meet your expectations, 5) will not be disclosed to third parties, or 6) have errors or omissions corrected. Any content accessed or submitted through the site is done so at the sole risk and discretion of the user, and that user bears all responsibility for any loss or damage arising from such activity. No communications from AHN, whether verbal or written, will create any warranty not expressly stated in these terms.
11. AHN shall not be liable for damages of any kind (including, but not limited to, any direct, indirect, incidental, general, special, consequential, exemplary or punitive damages) even if AHN has been advised of the possibility of such damages arising from or relating to: 1) the use or inability to use the services, 2) the cost of replacement of any goods, services or information purchased or obtained as a result of any information obtained from or transactions entered into through or from the services, 3) disclosure of, unauthorized access to or alteration of any user's information, 4) damages for loss or corruption of data or programs, service interruptions or procurement of substitute services, even if AHN knows or has been advised of the possibility of such damages, 5) statements, conduct, or omissions of any service providers or third parties on AHN's services, 6) any user's or other person's conduct or acts in connection with the use of AHN's site or services, including, without limitation, bodily injury, emotional distress, death or any other damages resulting from communications or meetings with other registered users of our services or persons introduced to you by AHN's services, whether on-line or off-line, or 7) any other matter arising from, relating to or connected with AHN's services or these terms. AHN shall not be liable for any failure or delay in performing under these terms, whether or not such failure is due to causes beyond AHN's reasonable control. In no event shall AHN's aggregate liability to any user or third party in any matter arising from or relating to AHN's services or these terms exceed the sum of one hundred US dollars ($100.00). Some jurisdictions doe not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the limitations of sections ten and eleven may not apply to you.
